In 2018, member states of the African Union signed the African Continental Free Trade Area Agreement (AfCFTA) to implement a single continental market for goods and services and establish a continental customs union. This book focuses on Phase II of the agreement which is particularly related to negotiations for an Investment Protocol based on the text of the 2016 Pan African Investment Code (PAIC).
Divided into two parts, the first discusses various aspects of the prospective regional investment regime protection, merging the pre-existing web of bilateral agreements. Part II discusses sector-specific topics and the extent to which those have been addressed, failed to be addressed or coincided with the AfCFTA, such as commercial arbitration, food security, intellectual property, data flows or government procurement.
Written by a combination of academics and practitioners, the work will be a valuable resource for those working in the areas of International Economic Law, International Trade Law, African Law and Development.
